A Utica man was convicted of two tax-related felonies in Cayuga County yesterday, after a year-long investigation revealed that he illegally possessed and transported over 38,000 untaxed, unstamped cigarettes.
The Cayuga County District Attorney’s office says that on August 4th of last year, 40-year-old Timothy Heburn Jr. was pulled over and arrested on the NYS Thruway in the Town of Brutus.
Police found more than 190 cartons of Seneca cigarettes in Heburn’s vehicle and charged him with two felonies related to tax evasion and fraud.
His trial was supposed to begin yesterday, but instead he entered guilty pleas to both felony charges.
In addition to sentencing, he will have to pay back over $8,000 in taxes he avoided.
