A Tioga County man was yesterday (September 12) indicted by a grand jury on multiple counts of second-degree murder, related to the death of his infant daughter back on June 9.
The defendant is 25-year-old Cody Franciscovich, accused of killing his eight-month-old daughter, Ruby.
State Police were called to the area on June 10, when the child was reported missing from a motel in the town of Tioga where she and Cody were living with the child’s mother and two other children.
During their search, police were called to a nearby location where Franciscovich was discovered to be without clothing.
He then brought police to an adjacent pond behind the St. Patrick’s Cemetery on Route 17C, where Ruby’s body was ultimately found.
If convicted of his charges, Franciscovich could now face 25 years to life in jail.
Yesterday’s indictment downgraded his original first-degree murder charge, which previously accused him of sexually assaulting Ruby before killing her.
That could have meant life in prison sentence if convicted, but his sex crime charges have now been dropped.
