Many were surprised to see ice cream being served yesterday at Super Scoops on South West Street in Homer.
Since last September, the shop has been facing closure due to a proposed Dollar General.
The town planning board denied an application last month after months of review, sending the project back to the drawing board.
“So to speak, the ball is in their court at this point,” a town official told WXHC News.
Project applicant Dan Griffiths, of Griffiths Engineering, was hoping to build a more than 9,000 sq ft Dollar General store. It would have required demolishing Super Scoops to make way for the new site.
Griffiths can still appeal the town’s decision, or pursue other legal measures of having his plan reconsidered.
In the meantime, Super Scoops — at least for now — appears to be back in business.
