A State Supreme Court judge yesterday (May 9) ordered Moonbeam Capital Investments, the owners of Dewitt’s ShoppingTown Mall, to pay more than $9.7 million in outstanding taxes within 14 days to avoid foreclosure.
That ruling now forces the mall owner’s hand on taxes overdue to Onondaga County dating back to 2015.
The original lawsuit was filed by a company that bought the Macy’s property that year. It alleged the mall owner’s failure to pay taxes unfairly put the businesses inside in jeopardy.
Moonbeam Capital has long been arguing that it was acting in good faith not paying the taxes because it was challenging the tax assessment values.
Yesterday’s proceedings ruled that argument is no longer valid.
