Regan Development Asks For Site Plan Approval Extension For Mixed-Use Development Next to Country Max in Cortlandville – Town Attorney Raises Questions
First proposed nearly three years ago and gaining approvals in 2023, the Regan Development Corporation has requested an extension of their site plan approval for a mixed use development project at 968 Route 13 in the Town of Cortlandville. During last night’s Cortlandville Town Board meeting, the board voted to table any action towards the extension request by Regan Development after Town Attorney Fran Casullo raised concerns about the length of time that has passed since approval.
The reason the project has yet to be constructed is due to the project missing out on funding through the New York State Homes and Community Renewal (NYSHCR) grant funding. Plans were originally resubmitted last September in an attempt to secure funding on a second attempt through the NYSHCR for 2025. Unfortunately, Regan Development says they were not awarded funding for 2025.
However, Regan Development says after a debriefing with NYSHCR representatives regarding their second application for the project, they say their application scored high and only was not awarded funding due to “unusually high volume of applications to NYSHCR within this region of the state.” Resubmitting their application for funding means Regan Development will not hear back if they will be awarded funding until Spring 2026 and construction not starting for the project until that fall. Regan will resubmit their application this fall during the NYSHCR next review cycle.
Casullo says his concerns come from the date of when all the approvals were given. Those approvals include the site plan, SEQRA determination, aquifer permit, conditional permit, and area variance. Casullo, who was not the town attorney when Regan presented these plans, suggested some of the information from the original application could be stale given it has now been two years since approval and construction is anticipated in the Fall of 2026 at the earliest. Casullo suggested to the Town Board to table any action regarding an extension until he may review the project to ensure it is up-to-date. He went on to say he did not not want to see this happen, but to ensure all its approvals are good to go after three years.
The mixed use development project would consist of one 4-story building that’ll feature both residential and commercial space. The property would also include recreation space, and a playground. Total footage for the building would be 86,544 square feet, or 21,636 sf per floor. In total, there would be 68 multi-family units and 6.278 sf of commercial space. Access to the building would be shared by the entrance to Country Max currently.
