New York’s flavored e-cigarette ban has been blocked by a state supreme court justice, less than four months months after Gov. Cuomo and the state Health Department issued an emergency executive order back in September.
Acting state Supreme Court Justice Catherine Cholakis ruled that ban to be unconstitutional, stating that regulations on the vaping industry are a responsibility of the state legislature and not the executive branch.
The ban previously prohibited the sale of all flavored e-liquids other than tobacco or menthol across the state.
It was immediately challenged in court by leaders in the vaping industry which have now been granted an injunction against enforcement.
