Lawsuit prompts Delay in Plastic Bag Ban Enforcement

Officials with the state’s Department of Environmental Conservation will wait until April 1st to begin penalizing stores that violate the new single-use plastic bag ban.

The new law officially took effect Sunday (March 1) but is now being delay after a bag manufacturer and several convenience store owners filed suit in Albany County Supreme Court.

They’re claiming the ban is unconstitutional.

If the law survives, violators could eventually be subject to a $250 fine for a first offense and $500 fines for each time after.
