DA Announces Plea Deal With Man Who Crashed Vehicle in Cortland Last Year Killing One


Cortland County District Attorney Patrick Perfetti has announced a plea deal has been made with Ergardo Rosario last week. The deal resolves his pending indictment that would’ve charged Rosario with Aggravated Vehicular Homicide, Vehicular Manslaughter in the 2nd, Reckless Endangerment in the 2nd, DWI by drugs, and Reckless Driving.

It was on Saturday, February 25th 2023 around 7 in the morning, when emergency personnel responded to the area of 70 Homer Ave. in the City of Cortland for a single vehicle crash.

The vehicle, a white Nissan Versa, had crashed into a utility pole with Rosario and three other people occupying the vehicle. An adult female seated in a rear passenger seat, had died as a result of the crash. The remaining two passengers of the vehicle, a male and female, were transported to Upstate with serious injuries.

Ergardo Rosario was the driver of the vehicle at the time of the crash and only suffered minor injuries. Officers on scene then conducted a Drug Recognition Expert Evaluation and determined that Rosario was driving while under the influence of drugs. The crash was also captured on video surveillance from a neighboring property.

“This kind of tragedy is an all too stark reminder of the perils of intoxicated driving;” said D.A. Perfetti, “that’s why the full resources of my office were committed to this prosecution.”

Rosario had no previous criminal record and the D.A. ‘s Office says he will be sentenced as a result as a first felony offender on April 23. The State of New York will be seeking the maximum sentence of 5-15 years in state prison.

“There was a death in this circumstance, and where there is death, there must be an accounting…. I must commend the diligent work of the Cortland City Police Department for a thorough investigation that led quickly to an arrest;” stated DA Perfetti when asked by the defense the reason for the sentencing recommendation.
