D.A. Perfetti – Man Sentenced in Aggravated Vehicular Homicide Case


Cortland County District Attorney Patrick Perfetti has announced Ergardo Rosario has been sentenced after his conviction of Aggravated Vehicular Homicide earlier this week on April 23rd in County Court.

Rosario was sentenced by Cortland County Court Judge David Alexander to an indeterminate term in state prison of 3 to 15 years. Back in February of 2023, Rosario was driving while under the influence of drugs on Homer Ave. and struck a utility pole, killing one and seriously injuring two.

Cortland Police arrested Rosario at the scene and an investigation found he was traveling 47 mph in a 30 mph area, 5 seconds prior to the impact to the utility pole. Blood evidence presented during trial showed Rosario had been intoxicated with fentanyl, marijuana and methadone. The D.A. Office says Rosario also admitted to this.

“This case of drug intoxicated driving is an example of what other states have encountered upon the decriminalization of marijuana. This case serves as an example of the dangers and tragic results of drugged driving. This Office will stand ready to prosecute vigorously these cases. Unfortunately, the strongest prosecutions will never bring back those who’ve died.”
