This past Monday (December 13) in a surprise move from the Cortland Zoning Board of Appeals, the board turned down a request from Byrne Dairy for a zoning variance for property at the corner of River and Port Watson Streets.
Byrne Dairy had already received approvals from both the Cortland City Council and Planning Board; however, with this recent denial to the plan, it required a supermajority voted to pass the ZBA. The vote ended in a tie, 3 for and 3 against which means Byrne Dairy cannot move foward.
This does not mean the project is dead, Byrne Dairy has the option to appeal in court or make changes to the proposal and go through the process again.
