On Saturday, August 20, 2016, at about 8:54 pm, New York State Police at Homer arrested James P. Platt, 29, of Cortland.
Troopers say Platt was charged with the felony of aggravated driving while intoxicated with a child less than 16 years old.
Platt also faces the misdemeanors of operating a motor vehicle while impaired by drugs, criminal possession of marijuana, criminal possession of a controlled substance, endangering the welfare of a child and several traffic violations.
The State Police arrest occurred after Platt was seen failing to keep right as he drove on State Route 38 in the town of Harford.
An investigation determined that he was driving while impaired by drugs and had his four-year old child as a passenger.
Also, after officers smelled marijuana inside Platt’s vehicle, a search found that he unlawfully possessed about 35 grams of marijuana and a small amount of suboxone.
Troopers report Platt refused to submit to a test of his blood to determine his drug content.
Platt was arraigned in the Town of Virgil court and was remanded to the Cortland County jail in lieu of $5,000 cash bail or $10,000 property bond.
His next court date in the Town of Hatford is on Tuesday, August 23.
