Board To Examine Rezoning Options For Tompkins Street Area

Sonbyrne Sales – Byrne Dairy – asked the Town of Cortlandville to change the zoning for the area around the old Wilcox Tire property at 260 Tompkins Street.

Board members say they won’t authorize illegal spot zoning and Pam Jenkins put the board on notice. “So, we all know that since spot zoning is illegal, I’ll be very interested to listen to your discussion,” said Jenkins.

Board member John Proud did look into the zoning and reported to the Board he could not find why that stretch of Rt 13 was zoned B-2, when similar areas of the town are B-3.

First, Town Attorney John Folmer will prepare the documents in case the board wants to consider a zoning change. “There have been at least two interested parties in acquiring the uses that would be permitted in a B-3 zone.”

A town rezoning to B-3 would require an application for a special use permit to sell gasoline and any projects approved by the Town Planning Board.
