Rep. Lifton Renews Support For Dryden Drilling Ban
State Assembly Woman Barbra Lifton has renewed her support for the Town of Dryden’s ban on natural gas drilling.
Lifton has filed an amicus brief in connection with a lawsuit by a gas company's effort to overturn Dryden’s drilling ban.
Originally the lawsuit was filed by Anschutz Exploration Corporation, a natural gas drilling company based in Denver, Colo. The company argues that state’s oil, gas and solution mining law supersedes Dryden’s drilling ban.
Eventually Norse Energy took over the lawsuit.
Lifton along with others says that local municipalities have the right to enact bans on gas drilling including high volume hydraulic fracturing through home rule legislation.
State Supreme Court Judge Phillip Rumsey previously upheld Dryden’s ban, it was later upheld by a State Appellate Court.
Now Norse has appealed that decision to the state's highest court the court of appeals. The case is expected to be in front of the court as early as next month.
