Court Rejects Cortland County Man's Appeal of Sex Abuse Conviction
A State Appellate Court has upheld the the 2012 conviction of a Freetown man for sexually abusing a child and producing child pornography.
The State Appellate Court Third Department in Albany has rejected an appeal by 39 year old Paul O'Neill formerly of 2752 Center Road, Freetown.
O'Neill was convicted in Cortland County Court in January of 2012, he pled guilty to use of a child in a sexual performance and course of sexual conduct against a child in the first degree. O'Neill pled guilty to the charges as part of a plea deal to resolve the case against him. In exchange for the plea, O'Neill was sentenced to 15 years in prison and 20 years of post release supervision.
In his appeal O'Neill was looking to overturn his conviction and sentence, he claimed he was pressured into taking the plea deal because prosecutors threatened him with federal charges. O'Neill also claimed he was not properly represented by his court appointed legal counsel.
Five of the of the seven appellate Judges rejected O'Neill's claims and refused to overturn his conviction and sentence.
