Two Cortland County Business Owners Charged With Failing to Pay Worker's Comp Insurance
The owners of two local businesses have been charged with failing to pay workers compensation insurance.
 
Cortland County Sheriff's investigators acting on a complaint from the New York State Workers Compensation Board Enforcement Unit out of Binghamton have arrested 49 year old Mark Fezza, who owns and operates Superior Limousine located at 991 Route 13 in the Town of Cortlandville and 47 year old Randy Metcalf, the owner of American Taxi located on N. Homer Ave. also in Cortlandville.
 
Investigators say over the last five years both men have been operating their business's without paying state required workers compensation insurance.
 
Fezza was charged with one felony count of failure to secure compensation of workers compensation coverage.
 
Metcalf was charged four felony counts of failure to secure compensation of workers compensation coverage.
 
The charge is class "E" felony under the workers compensation law. 
 
Fezza was arrested last October and charged with one count of grand larceny,  two counts of criminal tax fraud, and two counts of repeated failure to file personal income tax returns; all felonies.
 
The charges stem from an investigation by the State Department of Taxation and Finance which found that Fezza collected but failed to remit to New York State more than $180,000 in sales taxes from March, 2004, through September, 2009.  He also failed to file sales tax returns since July 2004, and failed to file personal income tax returns since 1998.

That case is still pending.
 
Both Fezza and Metcalf were ticketed and released; they are due in Cortlandville Court at a later date.
