Lifton Files Legal Brief in Support of Dryden Gas Drilling Ban
New York State Assembly woman Barbra Lifton has resubmitted court documents arguing on behalf of the Town of Dryden’s ban on natural gas drilling.
Lifton has filed an amicus brief in connection with the lawsuit by the gas company to overturn Dryden’s ban.
Originally the lawsuit was filed by Anschutz Exploration Corporation, a natural gas drilling company based in Denver, Colo. The company argues that state’s oil, gas and solution mining law supersedes Dryden’s drilling ban.
Now Anschutz has assigned the Dryden gas leases to Norse Energy who is also taking over the lawsuit.
Lifton along with others says that local municipalities have the right to enact bans on gas drilling including high volume hydraulic fracturing through home rule legislation.
State Supreme Court Judge Phillip Rumsey upheld Dryden’s ban last February, the case is now before the State Appellate courts to review that decision. It’s expected the case could go to the highest court, the court of appeals.
