Federal Court Upholds N.Y Gun Law
Wednesday, November 28, 2012
A federal Appeals court has upheld a New York gun law requiring a permit to carry a concealed handgun.
The three-judge panel rejected the challenge to New York's handgun licensing statute.
Five Westchester County residents along with the "Second Amendment Foundation" argued that the "proper cause" part of New York's gun law violates the second amendment
The "proper cause" provision of the gun law requires the gun owner r to show a special need for protection that is greater than the rest of the community.
The decision by the federal court means New York’s gun law is constitutional and does not abridged second amendment rights.
