The defense for a Cortland man accused of raping a girl over several years is set to wrap up his case today, the matter could be in the jury hands by this afternoon.
Testimony resumed Monday in Cortland County Court in connection with the trial of 48-year-old Fred Brown of 5 Crawford Street, Cortland.
Brown's accused of 14 different Charges including rape, criminal sex act, attempted criminal sex act, and endangering the welfare of a child.
Brown was arrested by Cortland City Police in September of last year, he is accused of having forcible sexual contact with a girl starting in November of 2001 when the victim was 12 years old, the abuse stopped about five years later when the victim turned 16.
The victim testified that Brown raped her at least once a week over the five year period and at one point she became pregnant with his child, the teen had an abortion and Brown is accused of forcing the teen to lie to her mother and others about how she got pregnant.
Yesterday, the victims husband took the stand, the man testified about his lengthy drug and criminal history, having been to prison at least twice. The man recounted the events that led the victim to disclose the abuse. That disclosure occurred after the vcitms husband and Brown had been involved in a fight on the victims 21st birthday, shortly afterward the victim attempted to tell her mother of the abuse, then eventually took her story to the police.
Defense attorney Keith Dayton raised questions about whether Hutchings had prompted the victim to make the rape allegations as an act of revenge against Brown. Hutchings ex girlfriend Heather Hudson took the stand and indicated that Hutchings had asked her to make false rape allegations years before.
Private investigator Mike Bidwell took the stand, he testified that after inspecting a bathroom where some of the abuse is alleged to have occurred he could not see into the bathroom as the victims brother had described in prior testimony, however Bidwell did not confirm if the bathroom or the door had been altered in the years that followed the alleged rape.
Dayton will call his final witnesses today.
