Truxton Man Accused in July Fatal D-W-I Crash Due in Court Today
A Truxton man who was indicted by a Cortland County Grand Jury in connection with a fatal alcohol related crash on Route 13 back on July 6th is due in Cortland County Court today for an arraignment.
21-year-old Derek R. Manwarren of 3944 Route 13 was indicted earlier this month on felony charges of driving while intoxicated and vehicular manslaughter in connection with the Route 13 crash that claimed the life of a Fabius man.
The collision occurred on Route 13 in Truxton in the early morning hours of July 6th.
The investigation revealed Manwarren who had been drinking at bars in Cortland prior to the crash was operating his truck northbound on Route 13; he came upon two other trucks parked on the East shoulder of the roadway near the Twin Oaks Dairy Farm. The two-parked vehicles were partially in the roadway. Manwarren’s vehicle struck the rear of the first parked truck, and then he hit the second vehicle. Manwarren struck and killed 26-year-old Brian R. Cook of Fabius who was in the roadway preparing to change a flat tire on one of the trucks.
At the time of the crash State Police found an open alcohol container in Manwarren’s truck.
Manwarren was initially arraigned in the Town of Preble Court and remanded to Cortland County Jail in lieu of $50,000 cash $100,000 bond.
Manwarren will appear before County Judge William Ames where he will be formally arraigned on the amended charges, Judge Ames can revisit the bail and bond issue and decide if the amounts should be increased or lowered.
